1. Introduction
Welcome to Myshop11.com. These Terms and Conditions govern your use of our website and the 360° Virtual Tour photography services provided by Myshop11 (“we”). By hiring our services, you (“the Client”) agree to be bound by these terms.
2. Services and Delivery
Myshop11 provides high-resolution 360° photography and virtual tour creation services for commercial and residential properties.
The final virtual tour will be delivered to the Client via a web link, embed code (for websites), and uploaded directly to the Client’s Google My Business (GMB) profile, as agreed upon in the service package.
Delivery timelines will be discussed prior to the shoot. Any delays caused by the Client (e.g., location not ready, lack of access) may extend the final delivery date.
3. Client Obligations and Site Preparation
The Client is responsible for ensuring the property is clean, organized, and fully staged before the scheduled shoot time.
The photographer will shoot the location “as is.” We are not responsible for moving furniture, cleaning, or removing confidential items from the camera’s view.
The Client must secure all necessary permissions from property owners, management, or guests to allow photography on the premises.
4. Payment and Cancellation Policy
A non-refundable advance payment (as agreed upon in the quote) is required to book and confirm a shoot date.
The remaining balance must be paid in full upon the delivery of the final virtual tour or before it is published live on Google Maps.
If the Client cancels or reschedules the shoot within 24 hours of the agreed time, a rescheduling fee may apply.
5. Copyright and Intellectual Property
Myshop11 retains the original copyright to all raw images, panoramic photos, and digital assets created during the shoot.
Upon full payment, the Client is granted a non-exclusive, perpetual license to use the final 360° Virtual Tour for their own promotional, marketing, and commercial purposes across their website and social media.
Myshop11 reserves the right to use the completed virtual tours in our own portfolio, website (myshop11.com), and promotional materials unless a strict Non-Disclosure Agreement (NDA) is signed prior to the shoot.
6. Third-Party Platforms (Google Disclaimer)
While we are a Virtual Tour Agency optimizing content for Google Maps, Myshop11 does not own or control Google.
We guarantee the successful upload of the 360° tour to your verified Google My Business profile. However, we cannot guarantee specific search engine rankings or permanent placement, as Google frequently updates its algorithms, policies, and platform features.
If Google removes or alters the tour due to policy violations by the Client’s business, Myshop11 shall not be held liable.
7. Limitation of Liability
Myshop11 shall not be held liable for any direct, indirect, or consequential loss of business, profits, or data resulting from the use of our virtual tours or website services. Our maximum liability in any dispute shall not exceed the total amount paid by the Client for the specific service.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Nagpur, Maharashtra.
